PARKER:While John Goodwin is busy discussing with Mr. Tang in the Foreign Economic and Trade Arbitration Commission, I attend a reception which is given in another part of the CCPIT Building.It is a reception in honour of the inauguration of the China Global Law Office, and the main speech is given by one of the deputy directors of CCPIT.

CHEN:The Trade-Mark Office, of course,gives precedence to the person who files first.It examines the application, issues preliminary approval and publishes the trade-mark.If there’s no justifiable opposition to it. then the registration is approved and a trade-mark registration certificate is ssued.

PARKER:How long is it between the date of publication and the date of approval?

PARKER: How long will the registered trade-mark remain valid?

CHEN: Ten years from the date of registration.

PARKER: What if you want to continue to use the trade-mark?

CHEN:You have to apply for a renewal within six months before expiry.Each renewal is good for ten more years.

PARKER: Hmmm. Now, can we assign a trade-mark to anothers person or company?

CHEN:Yes. You can.

CHEN: By filing a joint application with the assignee with the Trade-Mark Office. The assignee should, of course guarantee the quality of the goods when he uses the registered trade-mark.

PARKER: Naturally.Now, what do you do if you find somebody infringing your trade-mark.

CHEN: You put in a request to the Administrative Authority for Industry and Commerce, You ask them to look into the matter. This body has the authority to order the offender to stop the infringement and to compensate you for the damage. or you can take your case to the People’s Court.

（你就向工商行政管理部门提出要求，请他们调查这件事， 工商行政管理部门有权责令侵权人停止侵权行为。赔偿你的损失，你也可以向人民法院起诉。）

PARKER: Just a moment ago you mentioned CCPIT. I’m going to approach them.

CHEN: I’m sure they’ll help you. They’ve been working in the area of trade-mark for 30 years for our foreign friends, They’ll help you get exclusive rights to your trade-makrs。
